2019 Legislation Affecting Estate Planning and Administration
The Montana Legislature made important revisions to our intestacy, elective share, and exempt property statutes. Senate Bill No. 225 also changed some important probate procedural provisions. Further, courts may now correct mistakes in a will and other governing instruments if necessary to implement the testator's intention. The Bill included the adoption of the Uniform Disclaimer of Property Interests Act and the Uniform Real Property Transfer on Death Act.
